Agreement
These Terms form an agreement between you and HomeRound Development (“HomeRound,” “we,” or “us”) governing your download, installation, access to, and use of the HomeRound Android application and related support materials. By completing the app’s click-wrap, you agree to these Terms. If you do not agree, do not use HomeRound.
1. Eligibility and intended audience
HomeRound is intended for adults managing a household. You must be at least 18 years old and legally capable of entering this agreement to use the app. HomeRound is not directed to children.
2. Limited license
Subject to these Terms, HomeRound grants you a limited, revocable, nonexclusive, nontransferable, nonsublicensable license to install and use the app on devices you own or control for personal, noncommercial household purposes. HomeRound and its licensors retain all rights not expressly granted.
3. Acceptable use
You may use HomeRound only lawfully and consistently with these Terms. You are responsible for the task content you create and for decisions you make using the app.
- Do not reverse engineer, bypass security controls, distribute unauthorized copies, or use the app to violate another person’s rights, except where applicable law expressly permits the activity despite this restriction.
- Do not use HomeRound to store unlawful content or credentials, identity documents, medical records, financial account numbers, access codes, or other highly sensitive information.
- Do not represent HomeRound’s guidance as a professional inspection, certification, diagnosis, code determination, emergency instruction, or emergency-preparedness instruction.
4. Household guidance and safety
HomeRound provides general educational information and scheduling suggestions for routine household upkeep. It is not a home inspection, monitoring service, emergency service, or substitute for current manufacturer instructions, product labels, recalls, laws, codes, public-authority instructions, or advice and service from a qualified professional.
Content and schedules may be incomplete, outdated, inaccurate, or unsuitable for a particular home, product, climate, condition, person, animal, or jurisdiction. Conditions can change after guidance is displayed. You are responsible for deciding whether and how to act.
Do not perform work you are not trained, equipped, authorized, or able to perform safely. Stop and obtain qualified or emergency assistance if a condition appears unsafe, an alarm or authority directs you to act, or you are uncertain how to proceed. In an emergency, contact the appropriate emergency service or public authority rather than relying on HomeRound.
5. No professional relationship or assurance
Using HomeRound does not create a contractor-client, inspector-client, medical, veterinary, legal, financial, insurance, engineering, architectural, or other professional relationship. HomeRound does not inspect your property or verify that a task was completed correctly. A completion record is only your own status entry and is not a certification, warranty, or proof of condition or compliance.
6. Manufacturer, authority, and professional directions
Current manufacturer instructions, product labels, safety notices, recalls, warranties, applicable laws and codes, public-authority directions, and qualified professional advice take precedence over HomeRound. Product or service names belong to their respective owners. References do not imply endorsement or that HomeRound has verified third-party material.
7. Local data and user content
HomeRound stores routine information locally to provide the app. You retain responsibility for custom task names, schedules, and other content you enter. HomeRound does not review, monitor, or automatically upload that content. The Privacy Notice explains the app’s current data practices.
8. Device security and App Lock
The local SQLite database is held in private Android app storage but is not separately encrypted by HomeRound. Its protection depends primarily on Android, device file-based encryption, your device lock, and the condition and configuration of the device. A rooted, compromised, shared, or unlocked device can reduce those protections.
Optional App Lock is an additional interface control. It does not create an account, establish a user identity, encrypt the database separately, or replace the device lock. Android controls biometric and device-credential authentication.
9. Backups, exports, and data loss
HomeRound can create a password-encrypted backup only when you request one and choose its destination. HomeRound does not keep your backup password and cannot recover it. Losing the password or backup file may make the backup permanently unusable.
Files saved or sent through Android’s document interface, device storage, Google Drive, Dropbox, email, or another provider leave HomeRound’s private storage and are controlled by you, the device, and the selected provider. Deleting HomeRound data or uninstalling the app does not delete exported files.
Local data may be lost because of deletion, uninstall, device loss or damage, operating-system behavior, storage failure, database corruption, migration failure, or lack of a usable backup. You are responsible for maintaining any backup you need.
10. Updates, compatibility, and availability
HomeRound may provide updates that change features, supported devices, content, or these Terms. We do not promise that the app will always be available, error-free, compatible with every device or Android version, or maintained indefinitely. We may modify or discontinue the app, subject to applicable law.
11. Intellectual property and feedback
The app, built-in task library, design, branding, software, and documentation are owned by HomeRound or its licensors and are protected by applicable intellectual-property laws. If you voluntarily provide feedback, you grant HomeRound a worldwide, perpetual, irrevocable, royalty-free right to use it without obligation to you, provided that this does not transfer ownership of your local task content.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEROUND IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, SAFETY, AVAILABILITY, OR RESULTS. HOMEROUND DOES NOT WARRANT THAT GUIDANCE WILL IDENTIFY, PREVENT, OR CORRECT ANY CONDITION, LOSS, INJURY, CODE ISSUE, PRODUCT FAILURE, OR NEED FOR SERVICE.
FOR WASHINGTON CONSUMERS, HOMEROUND SPECIFICALLY DOES NOT WARRANT THAT THE APP OR ITS GUIDANCE WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, SAFE, AVAILABLE, ERROR-FREE, SUITABLE FOR A PARTICULAR HOME OR PURPOSE, OR CAPABLE OF IDENTIFYING, PREVENTING, OR CORRECTING A CONDITION, LOSS, INJURY, CODE ISSUE, PRODUCT FAILURE, OR NEED FOR PROFESSIONAL SERVICE.
Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms disclaims or limits an implied warranty, statutory remedy, or consumer right to the extent Washington law or other applicable law prohibits that disclaimer or limitation.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEROUND AND ITS OWNERS, CONTRIBUTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OR CORRUPTION OF DATA; LOSS OF USE; OR THE COST OF SUBSTITUTE INSPECTION, SERVICE, PRODUCTS, OR DATA RECOVERY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEROUND’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO HOMEROUND FOR THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR TEN U.S. DOLLARS.
These exclusions and the liability cap apply only to the extent permitted by law. They do not apply to fraud, willful misconduct, gross negligence, violations of nonwaivable statutory rights, or personal-injury or property-damage liability to the extent Washington law or other applicable law does not permit that liability to be excluded or limited.
14. Third-party services and platform terms
Google Play, Android, device manufacturers, and user-selected storage or document providers are independent third parties. Their products, processing, availability, and terms are outside HomeRound’s control. Your use of those services is governed by their terms and privacy policies. Google is not responsible for providing maintenance or support for HomeRound except as required by applicable platform terms or law.
15. Termination
These Terms remain effective until terminated. You may terminate them by ceasing use and uninstalling HomeRound. Your license terminates automatically if you materially violate these Terms. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, and dispute provisions—will survive.
16. Changes to these Terms
The effective date and version identify the Terms presented to you. Material changes will be presented for renewed acceptance before the changed Terms govern continued use. Changes to data practices will also be disclosed and consent obtained when required. Declining updated Terms will not itself delete local data; the app will provide access to review the terms, create an encrypted backup, or delete local data.
17. Governing law and disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles, except where the law of your residence requires otherwise. Subject to nonwaivable consumer rights, disputes arising from these Terms or HomeRound may be brought in the state or federal courts located in Washington, and you and HomeRound consent to their jurisdiction. These Terms do not require arbitration or waive participation in a class action.
18. General terms
These Terms, together with the incorporated Privacy Notice and Guidance Boundaries, are the entire agreement about the app and supersede prior app-use understandings. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without HomeRound’s consent; HomeRound may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the app, subject to applicable law.
19. Contact
Questions may be sent to HomeRound Development at support@homeround.app. Do not email backup passwords, backup files, credentials, or highly sensitive task content.
Guidance Boundaries
These boundaries are an important part of the Terms and apply whenever HomeRound displays a task, schedule, explanation, reminder, or completion record.
General educational guidance only
HomeRound’s built-in tasks, schedules, explanations, and reminders are starting points for ordinary household planning. They are not complete or universally applicable, and they do not establish the condition, safety, legality, maintenance needs, or value of any home, system, product, person, or animal.
Follow controlling instructions
Always follow current manuals, manufacturer instructions, product labels, recalls, warranties, applicable laws and codes, public-authority directions, and qualified professional advice when they differ from or are more specific than HomeRound.
Use safe judgment
Do not attempt work involving unsafe access, heights, ladders, roofs, electricity, gas, fire, structural systems, hazardous materials, concealed systems, specialized tools, or other hazards unless you are properly trained, equipped, authorized, and able to do so safely. Stop and seek qualified or emergency help when a condition appears dangerous or uncertain.
No inspection, diagnosis, or proof of completion
HomeRound cannot observe your property, verify task performance, diagnose a problem, confirm compliance, or determine that professional service is unnecessary. Marking a task complete records only your selection and does not certify the work or condition.
